If your home is on a septic system, you may have already wondered whether that takes an accessory dwelling unit off the table.
The short answer is:
No. Being on septic does not automatically prevent you from building an ADU in Virginia.
In fact, many properties throughout Hampton Roads and rural Virginia rely on private septic systems, and those homeowners may still have several paths available for adding an accessory dwelling unit.
The bigger question isn’t simply:
“Do I have septic?”
It is:
“Can my property’s existing or proposed septic system support the additional living space I want to create?”
That is a much better question — and, fortunately, there are often several possible answers.
At 757 Building Co., we work with homeowners throughout Hampton Roads and surrounding areas where wells and septic systems are common. One of the first things we look at when evaluating an ADU project is how the property is currently served and what may be required to accommodate the proposed ADU.
Let’s walk through how it works.
How Does Septic Capacity Affect an ADU?
A septic system is designed to accommodate a certain amount of wastewater.
For residential properties in Virginia, that capacity is commonly associated with the number of bedrooms the system was designed and permitted to serve.
Your septic documentation may therefore show something such as:
- 3-bedroom capacity
- 4-bedroom capacity
- 5-bedroom capacity
- Or a permitted daily design flow

That matters because adding an ADU can potentially increase the wastewater demand on the property.
For example, imagine you own a three-bedroom home served by a septic system that was approved for four bedrooms.
Depending on the proposed ADU design and local approvals, that existing additional capacity could potentially become very helpful.
Now imagine the same three-bedroom home is served by a septic system permitted for only three bedrooms.
That does not necessarily mean you cannot build an ADU.
It simply means we may need to investigate another solution.
First Step: Find Out What Your Existing Septic System Was Approved For
Before assuming anything, start with the records.
Depending on the age of the property, there may be records showing:
- The septic tank location
- Drainfield location
- Reserve drainfield area
- Number of bedrooms permitted
- System design
- Installation or repair permits
- Alternative septic system information
- Well location
- Previous soil evaluations

Sometimes we get lucky.
The existing system may already have enough approved capacity to accommodate what the homeowner wants to do.
Other times, more investigation is needed.
That is where a qualified septic designer, onsite soil evaluator, engineer, or health department review can become part of the feasibility process.
What If My Existing Septic System Isn’t Large Enough?
This is where homeowners sometimes hear the word “septic” and immediately assume the project is dead.
Not so fast.
There can be several possibilities.
1. Expand the Existing Septic System
If the property has suitable soils and adequate space, it may be possible to expand the existing septic system or drainfield to accommodate additional capacity.
Virginia Department of Health specifically notes that when proposed residential development exceeds the number of bedrooms an existing onsite system was designed to accommodate, a construction permit may be required to expand the system. (Virginia Department of Health)
That is an important distinction.
The rule isn’t necessarily:
“Your current system isn’t big enough, therefore no ADU.”
It may instead be:
“Your current system isn’t big enough, so let’s determine what is required to make it big enough.”
Those are very different conversations.
2. Install a New Septic System
On some larger properties, it may make more sense to install a new or redesigned system capable of supporting the overall property.
This becomes highly property-specific.
Available land, soil conditions, setbacks, existing improvements, wells, waterways, wetlands, easements, and the proposed ADU location can all matter.
3. Consider an Alternative Onsite Septic System
Conventional gravity septic systems aren’t the only option available.
Virginia also recognizes alternative onsite sewage systems, which use different treatment technologies than traditional conventional septic systems. (Virginia Law)
Alternative systems can sometimes provide solutions on properties where a conventional system is difficult or impossible.
They can also cost more and may have additional inspection, maintenance, or operational requirements, so they should be evaluated carefully.
But again, the important point is this:
A difficult septic situation is not always the end of the project.
Sometimes it simply changes the solution.
What About the Septic Reserve Area?
This is another major consideration.
Many properties served by septic have an area designated for the existing drainfield and another area reserved for a future replacement system.
That reserve area is extremely important.
One mistake homeowners sometimes make is choosing the “perfect” location for an ADU without realizing that the proposed building, driveway, garage, patio, or other improvements may interfere with the septic system or its reserve area.
That is why ADU feasibility should look at the entire property, not just whether there appears to be enough open space in the backyard.
We want to understand where everything needs to live:
- The primary residence
- The ADU
- Septic tank
- Drainfield
- Reserve drainfield
- Well
- Driveway
- Parking
- Utilities
- Property setbacks
- Easements
- Stormwater considerations
Sometimes moving an ADU 20 or 30 feet in one direction can make an otherwise difficult site work beautifully.
Can an ADU Have Its Own Septic System?
Potentially.
Whether this makes sense — or is permitted — depends heavily on the property and the local and state approvals involved.
On a larger rural parcel, there may be substantially more flexibility than on a small suburban lot.
A separate system could also introduce additional costs and design requirements, so it isn’t necessarily the first option we would pursue.
But it is another reason homeowners shouldn’t conclude that an existing septic system automatically determines the fate of their ADU.
The entire site needs to be evaluated.
What If My Property Is Also on a Private Well?
That’s common too.
Throughout places like Isle of Wight, Suffolk, Gloucester, Mathews, Surry, Southampton County and other parts of southeastern Virginia, properties may have both private wells and septic systems.
Again, this doesn’t automatically disqualify the property.
But wells add another piece to the site-planning puzzle.

The well location therefore needs to be considered when determining:
- Where the ADU can sit
- Where a new or expanded drainfield can go
- How utilities will reach the ADU
- Whether an existing well can serve the additional dwelling
For larger rural properties, there is often plenty of room to solve these issues.
For tighter lots, thoughtful planning becomes much more important.
Does an ADU Always Count as Another Bedroom?
Not necessarily in the simplistic way homeowners sometimes assume.
The proposed floor plan, sleeping areas, septic design, local interpretation, existing permit and intended use all need to be evaluated together.
This is also one reason ADU design matters.
A studio ADU is very different from a two-bedroom detached residence.
For example, someone building a small Freedom Studio for an aging parent or occasional guest may be presenting a very different wastewater demand than someone building a larger two-bedroom rental unit occupied full time.
Instead of designing the ADU in isolation and dealing with septic later, we prefer to evaluate these questions early.
Septic Should Be Part of ADU Feasibility — Not an Afterthought
This may be the biggest takeaway from this entire article.
Before spending significant money designing an ADU, it makes sense to determine whether the basic pieces of the property can support it.
That includes:
1. Zoning
2. Setbacks
3. Available building area
4. Septic or sewer
5. Water or well
6. Utilities
7. Access and parking
8. Drainage and site conditions
For septic properties, we want to determine as early as possible:
What does the existing system support, and if it isn’t enough, what options do we have?
Finding that answer early can save substantial time and money.
Don’t Let Septic Scare You Away From an ADU
There are thousands of beautiful homes throughout Virginia sitting on septic systems.
Many of those properties also happen to have something urban homeowners would love to have:
Land.
And land creates options.
That extra space can potentially accommodate an ADU for:
- Aging parents
- Adult children
- Multigenerational living
- Long-term rental income
- Furnished rental income
- Guest accommodations
- Caregivers
- A detached home office
- Downsizing while remaining on your property
So if you own a property on septic and have been thinking:
“I’d love an ADU, but I’m pretty sure my septic system means I can’t do it.”
Don’t assume the answer is no.
It might be.
But it might also be:
Your existing system already has capacity.
Or:
We need to expand the system.
Or:
We need to redesign it.
Or:
An alternative onsite system may work.
Or simply:
We need to move the ADU to a different part of the property.
In real estate and construction, there is often more than one path from Point A to Point B.
The goal of a good feasibility process is to find the one that makes the most sense for your property.
